1. About These Terms

These Terms of Service ("Terms") govern your use of elgrandpatron.com (the "Site") and any purchase you make from us. The Site is operated by ElgrandPatron, Parkweide 14, 6718 DJ Ede, Gelderland, Netherlands ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2. Who We Are

ElgrandPatron is an online retailer of outdoor power equipment and tools, based in Ede, the Netherlands. We source new products from third-party suppliers and sell them under the ElgrandPatron name. We sell to customers in the 48 contiguous United States.

3. Eligibility

You must be at least 18 years old to place an order. Power equipment is intended for adult use only.

4. Products and Descriptions

All products we sell are new. We aim to describe each product, its specifications, and its price accurately. If we find an error in a product description, image, or price, we will correct it, and if it affects an order you placed, we will contact you before shipping so you can confirm or cancel the order for a full refund.

5. Prices and Payment

All prices are in US dollars (USD). The total you pay, including shipping and applicable sales tax, is shown at checkout before you complete your purchase. Payment is taken in full when you place your order. See our Billing Terms for details.

6. Orders

After you place an order, you will receive an order confirmation email. We may decline or cancel an order if the item is out of stock, the price was listed in error, or we suspect fraud. If we cancel your order, we will notify you by email and refund the full amount to your original payment method.

7. Shipping and Risk of Loss

Shipping destinations, times, and costs are described in our Shipping Policy. Risk of loss passes to you when the order is delivered to the address you provided.

8. Returns, Refunds, and Warranty

You may return eligible items within 30 days of delivery as described in our Refund Policy. Products are covered by our 1-Year Warranty. Nothing in these Terms limits your rights under applicable consumer protection law.

9. Safe Use of Products

Read and follow the user manual and all safety warnings supplied with each product before assembly or use. You are responsible for using products only for their intended purpose.

10. Acceptable Use of the Site

You agree not to use the Site for any unlawful purpose, attempt to interfere with its security or operation, or copy its content for commercial use without our written permission.

11. Intellectual Property

The Site's content, including text, graphics, logos, and the ElgrandPatron name, belongs to us or our licensors and is protected by applicable copyright and trademark laws.

12. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased from it. Our total liability for any claim relating to an order is limited to the amount you paid for that order. This does not limit liability that cannot be limited by law.

13. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules. This choice of law does not deprive you of the protection of mandatory consumer protection laws of the place where you live. Please contact us first so we can try to resolve any concern informally. Any dispute that cannot be resolved informally will be heard by the competent court in the Netherlands, unless the law of your place of residence gives you the right to bring a claim where you live.

14. Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time you place an order applies to that order.
